Art 1. Content of the contract

§1 These general terms and conditions apply to contracts between the lessor – Care For You SRL, Place du remblai 15, 1480 Tubize (hereinafter: 'Apulia Wellness') following the rental of the rented space – and the lessee (hereinafter: 'the customer'). Apulia Wellness undertakes in this agreement to provide the customer with the personal use of its spaces for a certain time and for a certain price.

§2 Each space (Wellness & Riposo) has some of the following facilities and components: swimming pool, sauna, hammam, jacuzzi, salt cave, cold and hot showers, relaxing area, minibar, television, bed and decoration.

§3 A reservation (or a modification of the reservation) can only be made either by telephone, online, or by e-mail.

Art. 2. Prices Wellness / Riposo (Guest room)

§1 The amount due must be paid in full by the customer before the start of the space rental unless agreed otherwise.

§2 The price depends on the number of people and the number of hours for which a space is rented. Unless otherwise agreed between Apulia Wellness and the customer (reservation request, last-minute, promo, etc.), the rates below apply for people over 12 years old. Access to the wellness is free for people aged 12 or under as long as they are accompanied and registered during the reservation by min. 2 people over 12 years old.

Bundle Price – Bundle rate

The Bundle price includes the rental of the guest room and 2 hours of private spa for 2 people. For any additional hour in the private spa, 50.00 euros will be added to the initial price of the Bundle.

Art. 3. Reservation

§1 The agreement is only concluded upon full payment of the reservation. This amount can be found in the rates of article 2.

§2 The customer must pay this amount within 2 hours of the reservation request being sent in order to confirm the reservation. Otherwise, the reservation will be automatically cancelled.

§3 The customer can pay in 2 different ways: either by bank transfer to the account number mentioned in the reservation request, or on site.

§5 In the case mentioned in art. 3 § 3 and if the customer makes the payment by bank transfer, they undertake to immediately send the proof of payment by email to the address info@apuliawellness.be or apuliawellness.tubize@gmail.com.

§6 The amount must in any case be paid before the start of the session. Apulia Wellness reserves the right to unilaterally cancel the reservation without compensation if the customer does not comply with one of the conditions mentioned in this article.

§7 Apulia Wellness does not refund reservations, except in the following cases:

1. The customer's amount has not yet been received on the account of Apulia Wellness and the customer did not bring proof of payment at the time of consumption, so that they had to pay the full amount on site;
2. Apulia Wellness had to cancel or modify the reservation unilaterally due to a technical defect.

§8 Reservations will be refunded to the customer without interest no later than the 90th calendar day, from the date of receipt of the amount by bank transfer.

§9 Apulia Wellness reserves the right to unilaterally cancel the reservation if, according to the Apulia Wellness database, a defaulting customer has made more than one reservation without having paid.

§10 If the customer does not pay the supplements at the end of the session (or 7 days after the session if the payment is made by request for supplement by email), an interest of €12 will be automatically due without formal notice from the date of consumption, as well as a single flat-rate compensation of 10% of the total amount. The customer expressly waives their right (in accordance with Art. VI.47 et seq. of the Code of Economic Law) within a period of 14 days, without justification and without additional costs, to withdraw their reservation, their order, their gift voucher, or any purchase or service from Apulia Wellness.

§11 When paying the amount, the customer declares to agree with these General Terms and Conditions. In the event of force majeure or business closure due to external circumstances (such as regulations relating to COVID-19), the customer's amount will be kept on an advance account. Under no circumstances will the reservation amount be refunded.

Art. 4. Cancellation

§1 If the customer cancels the agreement less than 10 days before the rental, the fully due sum will be refunded. The customer can under no circumstances invoke cases of force majeure (e.g. accidents, bad weather, illness, death, impediment, etc.).

§2 If the customer cancels the agreement before a period of 24 hours preceding the rental, the reservation amount will be converted into a credit note and placed on a waiting list of Apulia Wellness to offer the customer the possibility of using it during a subsequent reservation at Apulia Wellness. The customer may only use the credit note in the branch where they paid the reservation amount.

§3 Apulia Wellness may cancel the agreement solely as a result of a technical defect or damage (the reservation amount will at this time be refunded in its entirety to the customer) or as a result of measures taken by the government (the reservation amount will at this time be placed on your personal Apulia Wellness account).

§5 Each amount paid for a reservation remains valid for a period of 2 years, either from the value date in the case of payment by bank transfer, or from the date of payment in cash at Apulia Wellness. After the expiration of this 2-year period, the amount will be charged as administration costs. This period may under no circumstances be interrupted.

§6 The reservation is automatically cancelled after a delay of 30 minutes following the start of the session.

Art. 5. Duties of Apulia Wellness

§1 Apulia Wellness undertakes to provide the customer with the quiet enjoyment of the entire space with all its facilities.

§2 Only in the event that the facilities show a serious defect, Apulia Wellness will give the customer a discount of a maximum of 40.00 euros per gift voucher if the defect was present during more than half of the duration of the session. A serious defect is understood to mean: the non-functioning of a facility such that it is inadequate for the use for which it is intended. The customer has the obligation to notify the defect immediately.

Art. 6. Duties of the customer

§1 After making the request, the customer receives an email with the reservation request. The customer is obliged to contact Apulia Wellness immediately if this does not correspond with the reservation they have made or if the customer has not received the email.

§2 Apulia reserves the right to check the reservation data using the customer's identity card in order to confirm the reservation. If the customer refuses to confirm the reservation, Apulia Wellness reserves the right to refuse the reservation.

§3 By approving these conditions, the customer is fully and jointly and severally liable for all damages and debts arising from this agreement, whether due to their own fault or that of a third party for whom they are responsible.

§4 The customer is obliged to use two towels and a pair of flip-flops per person in the spaces. These items can be rented at Apulia Wellness but can also be brought by the customer.

§5 The customer undertakes to be present a maximum of 5 minutes before the start of the session in order to carefully read this agreement. They must in any case strictly observe the start time according to the schedule indicated by Apulia Wellness. Non-compliance has no influence on the duty to respect the end time as indicated by Apulia Wellness and in no case gives the opportunity to claim compensation. Cases of force majeure on the part of the customer are expressly excluded and do not give the right to a refund under any circumstances.

§6 The customer undertakes to strictly respect the end time and to have left the space at this time. Upon non-compliance with this rule, Apulia Wellness will claim compensation of 15 euros per 10 min.

§7 The customer is entitled to a clean, proper space without visible traces of defects, unless they provide proof to the contrary. In the latter case, they will immediately notify the Apulia Wellness staff at the start of the session.

§8 The customer has the obligation to return the space in the condition in which they found it upon arrival, with the exception of the condition that is the consequence of the normal use of the facilities.

§9 It is absolutely forbidden for the customer to smoke in the space, to bring their own drinks or food, and to use electrical appliances. Garbage must be disposed of in the bins provided. Non-compliance with these instructions will entitle Apulia Wellness to invoice compensation according to the additional costs incurred (minimum 50.00 euros and maximum 300.00 not counting damages in case of additional cancellations ranging from 100.00 euros to 520.00 euros).

§10 The customer is forbidden to take photos of the space for publication purposes without written agreement from Apulia Wellness.

§11 In the space it is mandatory to use a towel in the sauna, to take a shower, foot bath after using the sauna or hammam and before using the swimming pool, to rest dry in the seats, to respect general hygiene, to eat meals at the table, to press the button in case of danger, to declare any damages caused and to compensate them. It is also forbidden to jump or dive into the pool or jacuzzi and to bring animals into the space.

Art. 8. Theft, responsibility, intoxication, behaviour, security and health

§1 Apulia Wellness reserves the right to deny access to the space to customers in a state of intoxication or who present inappropriate behaviour, customers who may endanger their own safety or health or that of others, or to remove them from the space with the possible imputation of a compensation of 50.00 euros.

§2 In the event of insubordination or theft, Apulia Wellness will immediately notify the police.

§3 Apulia Wellness is not responsible for accidents or damages that are the consequence of the loss of items or other damages, unless these are caused by a shortcoming in the Apulia Wellness facilities. It is the customer's obligation to lock the door.

§4 Apulia Wellness staff always have the right to enter the space during the session in case of danger, even if the customer has not given their consent.

§5 Apulia Wellness reserves the right to request one or more identity cards per sauna session and to scan them digitally.

Art. 9. Jurisdiction and applicable law

§1 These conditions apply to all agreements concluded from 11 July 2011.

§2 Belgian law only applies to this agreement.

§3 In the event of a dispute, the competent courts are exclusively those of the judicial district of Turnhout, namely the commercial court in Turnhout, the court of first instance in Turnhout or the justice of the peace of the canton of Westerlo, depending on the case at hand.

§4 The customer who booked the sauna session will be held liable by Apulia Wellness.
