General Terms and Conditions

1. General Provisions

These General Terms and Conditions govern the contractual relationship between Apulia spa et wellness and its customers.

Any order placed by the customer on the website wellness@apulia.be or addressed to Apulia spa et wellness by telephone is subject to the unconditional and unreserved acceptance of these General Terms and Conditions.

The customer acknowledges that their order constitutes full and complete acceptance of these General Terms and Conditions and that these prevail over their own General Terms and Conditions.

These General Terms and Conditions may be modified, in whole or in part, on the initiative of Apulia spa et wellness. The amendment to the General Terms and Conditions is notably brought to the attention of customers by publication on the Apulia website.

It is therefore the customer's responsibility to regularly refer to the latest version of the General Terms and Conditions permanently available on the website.

2. Registration on the website and access to services

Only customers registered on the website wellness@apulia.be can place an order with Apulia spa et wellness.

2.1 Registration on the Website

Registration requires the transmission by customers of the following data:

Customer information, such as surname, first name(s), private address, private telephone number, email, date of birth, national registry number, copy of the front/back of the identity card. These lists are by no means exhaustive and Apulia spa et wellness reserves the right to request additional information from the customer. Apulia reserves the right to refuse the opening of a customer account in the event of the communication of manifestly erroneous data.

2.2 Confirmation of registration and account security

Following registration on the website, the customer will receive the following information:

• An e-mail confirming registration on the website and containing information relating to the operation of the website.
• Access codes: a username, as well as a secret and confidential password.

The customer is solely responsible for the protection of the password they use.

The customer is solely responsible for the consequences relating to the communication, disclosure, loss, or theft of their password to third parties.

All orders placed on the website are registered by name and taken into account with the confidential password. They are presumed to emanate personally and directly from the customer.

3. Pricing and Payment

The prices are inclusive of VAT. Unless there is a specific promotional offer, the applicable rates for the services are those appearing on the website in force on the date of purchase.

All purchases, regardless of their origin, are payable in euros only.

Apulia reserves the right to modify its prices and services at any time without prior notice.

Validity of purchase:

The validity period of a purchase varies depending on the products:

• Apulia-Box: until 31.12 of the current year
• Gift voucher in € (face value): 24 months from the date of purchase
• À la carte gift voucher (Spa treatments, Wellness, …): 12 months from the date of purchase
• Seasonal offers gift voucher: see the specific conditions on each offer

If the validity period is exceeded and an extension is requested, Apulia spa et wellness reserves the right to adjust the rate of the service to those currently in effect.

4. Product and offer

You order services for personal use. Without prior authorisation, it is prohibited to resell for professional purposes these services acquired in the form of gift vouchers.

Apulia reserves the right to take appropriate legal action (according to trademark law).

Gift vouchers are payable in full at the time of purchase, they are not refundable.

Treatments, wellness entries, and other explicitly ordered and unconsumed services will not be refunded or exchanged.

5. Delivery conditions and times

Deliveries are only made against full payment of the services using accepted means of payment such as Visa, Mastercard, American Express.

6. Cancellation

To modify your appointment date and time, you can do so free of charge up to 48 hours before your reservation, by phone on 0470 55 39 12 and by email at wellness@apulia.be.

A reservation cancelled by the customer themselves will under no circumstances be refunded, but the customer will benefit from a voucher valid for a period of 3 months for an amount equivalent to the sum paid into the Apulia account.

7. Our right

We are entitled to withdraw from the contract also with regard to a part of the delivery or service still pending when it becomes apparent that erroneous information has been communicated to us, at any level whatsoever (identity, solvency, etc…).

8. Security

No data from your bank details passes through or is stored on our site. Online payment is made directly via the site of our banking partner, on their own systems.

9. Intellectual property

All texts, comments, works, illustrations, and images reproduced on the Apulia spa et wellness site are reserved under copyright as well as intellectual property rights and for the whole world.

Any other use constitutes infringement.

10. Applicable law & litigations

This contract is subject to Belgian law. The language of this contract is the French language and is the only one that is authentic.

In the event of a dispute, the Belgian courts (judicial district of Nivelles) will have sole jurisdiction.

11. Personal information

Apulia spa et wellness undertakes not to disclose to third parties the information you communicate to them. These are confidential. They will only be used by its internal services for the processing of your order and to strengthen and personalise the communication and product offer reserved for Customers.

Consequently, in accordance with the law, you have a right of access, rectification, and opposition to the personal data concerning you.

To do this, simply make a request online or by post, indicating your surname, first name, and address. Access to your account is secured by the use of cookies. If your browser does not accept cookies or if you have deactivated them, the use of this service will be impossible for you.
